1. Acceptance of Terms
By accessing or using Moshira's website, platform, APIs, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Services.
2. Description of Services
Moshira provides a multiomics data integration and AI-powered analytics platform for cancer research and precision medicine. The Services include data processing, biomarker discovery, molecular profiling, and clinical decision support tools.
3. Account Registration
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorized use.
4. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with applicable regulations, including HIPAA, GDPR, and other data protection laws. You may not reverse-engineer, decompile, or attempt to extract source code from the platform.
5. Data Ownership & Privacy
You retain ownership of all data you upload. Moshira processes your data solely to provide the Services and does not sell or share it with third parties. Our data handling practices are detailed in our Privacy Policy.
6. Intellectual Property
Moshira retains all rights to the platform, algorithms, models, documentation, and other intellectual property. You are granted a limited, non-exclusive, non-transferable license to use the Services during your subscription.
7. Service Availability & SLA
We target 99.99% uptime. Scheduled maintenance windows are communicated in advance. We are not liable for downtime caused by factors beyond our control, including internet outages, force majeure events, or third-party service failures.
8. Limitation of Liability
Moshira's total liability is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost data or lost profits, except where prohibited by law.
9. Termination
Either party may terminate the agreement with 30 days' written notice. Upon termination, we will export your data in a standard format within 30 days. After that period, data will be securely deleted.
10. Governing Law
These Terms are governed by the laws of the State of Delaware, USA. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the platform at least 30 days before they take effect.
